UAE Gratuity Law Reform: How the 2021 Decree Abolished the Resignation Penalty
Until early 2022, resigning early from a UAE job could cost you a big chunk of your end-of-service gratuity. That penalty is gone now, but plenty of people, and even some HR departments, are still working off the old rules. This article explains what changed, why it changed, and what the law says today, so you know which version of the rules genuinely applies to you.
The Old Rule (No Longer in Effect)
Previously, employees on unlimited contracts who resigned voluntarily before completing five years of service received a reduced gratuity, sometimes as little as one-third of the full entitlement if they left within the first three years. This penalty encouraged people to stay in jobs longer than they wanted, purely to protect their end-of-service benefits.
What the Law Says Now
The reform, Federal Decree-Law No. 33 of 2021, replaced unlimited contracts with fixed-term contracts, which can be renewed by agreement. Its provision on end-of-service benefits grants gratuity to a full-time worker who has completed at least one year of continuous service, and it contains no reduction for resignation. So whether you resign or are terminated, the same gratuity calculation applies.
A Caveat for Old Unlimited Contracts
Article 68 of the law is a transition rule. It allows an employer, when adjusting an old unlimited-term contract, to calculate end-of-service benefits under the old law's provisions. If your contract dates from before 2022, ask HR how your earlier service is being treated. Our guide on how to calculate gratuity for unlimited contracts covers that background.
How Gratuity Is Calculated (Same for Both)
- 21 days of basic salary per year for the first 5 years of service
- 30 days of basic salary per year for service beyond 5 years
- Total gratuity cannot exceed two years' wage
This formula applies uniformly. The "reason for leaving" no longer changes the outcome.
Notice Period Still Matters, But Separately
While gratuity itself isn't reduced for resignation, you're still required to serve your notice period (the law sets it between 30 and 90 days). Failing to do so can lead to a separate compensation payment owed to your employer. This is distinct from your gratuity calculation. See our guide on notice period and gratuity for how the two interact.
Why the Confusion Persists
Many older resources still describe the pre-2022 reduction rules, which is why the "resignation vs termination" question keeps coming up. Always check that any article, calculator, or advice you're using reflects the current law rather than outdated information.
A Note on Termination for Cause (Article 44)
Many people assume that dismissal for serious misconduct under Article 44 automatically cancels gratuity. The text of the current law does not provide for that. Article 44 sets out the grounds and procedure for dismissal without notice, and the gratuity provision grants end-of-service benefits to a full-time worker with one year of continuous service without carving out Article 44 dismissals. Some older sources still repeat the pre-2022 rule. See our guide on what Article 44 actually says about gratuity for the details.

Skip the manual math. Use our free UAE Gratuity Calculator 2026 to estimate your payout based on your basic salary and your first and last working day. Since the current law treats resignation and termination the same way, you don't need to choose how your employment ended.

Frequently Asked Questions
Does resigning reduce my gratuity under current UAE law?
No. Under Federal Decree-Law No. 33 of 2021, resigning after completing at least one year of continuous service entitles you to your full gratuity calculation, the same as if you were terminated.
When did the resignation penalty rule stop applying?
It stopped applying when Federal Decree-Law No. 33 of 2021 took effect in early 2022. The current law replaces unlimited contracts with fixed-term contracts and contains no reduction for resignation. A transition rule in Article 68 can matter for old unlimited contracts, so check with HR.
Is there any situation where the reason for leaving still affects my gratuity?
Mostly no. The reason for leaving doesn't change the formula. The main limits are the one-year minimum service, the two-year wage cap, and the Article 68 transition rule for old unlimited contracts. Dismissal under Article 44 does not by itself cancel gratuity.
Does not serving my notice period reduce my gratuity?
No, not directly. Gratuity itself isn't reduced, but failing to serve your notice period can create a separate compensation obligation owed to your employer, distinct from your end-of-service gratuity.
Is the gratuity formula different for resignation versus termination?
No. Both use the same formula: 21 days of basic salary per year for the first 5 years, and 30 days per year beyond that, capped at two years' wage.
Why do some articles still say resignation reduces gratuity?
Many older sources haven't been updated since the reform and still describe the pre-2022 rules. Always confirm that the information you're relying on reflects the current law.
